Welcome to North & Story. These Terms and Conditions govern your use of our website design and workshop services. By engaging with us, you agree to comply with and be bound by the following terms.

1. Service Engagement
North & Story provides professional website design, branding workshops, and consultation services. A project officially begins once the required deposit has been received and North & Story has confirmed your booking in writing.


2. Business Story Workshop
Our design process is rooted in the Business Story Workshop. Client participation is essential. The Business Story Workshop forms the foundation of every website project. Client participation and timely feedback are essential to the success of the project. North & Story is not responsible for delays caused by late content, feedback, approvals or other information required from the Client.

3. Fees and Payments
Fees are outlined in each individual proposal or invoice.. A non-refundable deposit is required to secure your booking. Final payment is due prior to the official launch or transfer of the website. North & Story reserves the right to pause work if payments are overdue. Requests received after final approval or website launch will be treated as additional work and charged at the applicable hourly rate.

4. Intellectual Property
Upon final payment, ownership of the completed website content and custom design created specifically for the Client transfers to the Client. the ownership of the website design and layout is transferred to the Client. North & Story retains the right to showcase the completed work in our portfolio and marketing materials unless a non-disclosure agreement is specifically requested.

5. Client Responsibilities
The Client is responsible for providing all necessary content, including text, logos, and high-resolution images, unless North & Story is contracted to provide these. You must ensure you have the legal right to use any materials provided to us. The Client is responsible for reviewing all website content prior to launch and confirming its accuracy.

6. Revisions and Scope
Our standard packages include a set number of revision rounds. Requests outside the original project scope will be quoted separately. Significant structural changes requested after the design phase is completed may incur additional fees.

7. Maintenance and Support

Standard website builds include a launch walkthrough and basic website training.

Ongoing website maintenance, hosting, domain registration, premium apps, third-party subscriptions and platform fees (including Wix) are the responsibility of the Client unless otherwise agreed in writing or a separate maintenance plan is in place.

Following website launch and training, the Client is responsible for the ongoing management of their website unless an ongoing support or maintenance service has been agreed in writing.

North & Story is not responsible for issues arising from changes made by the Client or third parties after the website has been launched.

8. Limitation of Liability
North & Story will perform all services with professional care. North & Story is not responsible for interruptions caused by third-party providers including hosting companies, domain registrars, payment processors or software providers.. However, we are not liable for any lost profits, data loss, or indirect damages resulting from the use of the website or third-party platforms (e.g., hosting providers).

 

While North & Story follows current SEO best practices when building websites, we cannot guarantee specific search engine rankings, website traffic, enquiries or business outcomes. Search engine performance is influenced by many factors beyond our control, including competition, search engine algorithms and the ongoing management of your website.

9. Cancellation
Either party may terminate the project with written notice. In the event of cancellation, all work performed up to the termination date will be invoiced, and the non-refundable deposit will be retained. Any completed work remains the property of North & Story until all outstanding invoices have been paid.

 

10. Project Timeframes.

Projects rely on timely communication and content from both parties. If the Client is unresponsive for more than 30 days, North & Story may place the project on hold. Projects inactive for more than 90 days may be considered cancelled, and any restart may incur additional fees.


11. Governing Law
These terms are governed by the laws of New Zealand. Any disputes arising from these conditions will be subject to the exclusive jurisdiction of the New Zealand courts.
